PERSONAL IMMIGRATION LAW
UK VISIT VISA
UK visit visas are an extremely important tool in keeping you and your family and loved ones connected around the world. The majority of our clients often come to the United Kingdom to see family members or, simply as tourists.
When applying for a UK visit visa or Family Visit Visa, the Home Office / Entry Clearance Officer’s tend to look at a number of things when deciding whether you are a genuine visitor and that you will go back home once your visit has finished.
- Your family ties to your home country;
- The reason you are visiting the United Kingdom;
- Your job / business ties to your home country;
- The property you own;
- Your previous immigration history;
- Your overall character and conduct;
- Your financial situation.
In addition to these factors, the Entry Clearance Officer will also consider:
- Whether you can accommodate yourself without recourse to public funds;
- That you will not work in the United Kingdom;
- That you will not use visit visas to secretly stay in the United Kingdom for long period;
- That you will have sufficient funds to cover your reasonable costs in relation to your visit;
- Visitors are permitted to engage in incidental studies for up to 30 days and obtain private medical treatment;
How we can help you apply for a UK visit visa
A carefully prepared application for a visit visa carries strong chances of success under Appendix V of the Immigration Rules. At SMA, we will assist in carefully planning your application to ensure that the Entry Clearance Officer can clearly see what your circumstances are and why it is that you are a genuine visitor and eligible for a visit visa or family visit visa. We think outside of the box in terms of providing evidence that the Entry Clearance Officer may not otherwise have requested but would show that you are a “genuine visitor”.
SMA is able to help clients who are not in the United Kingdom but need to make an application from their country of residence. Our sophisticated IT systems allow us to work on the application with you however you prefer, whether that is by video link or phone. There are various other tailored types of visa, for examples for clients seeking to marry in the United Kingdom whilst on a visit visa, to obtain private medical treatment and business visitors.
Has your visit visa been refused?
If you have had an application for a visit visa refused, SMA can give you tailored and detailed advice as to what you or your loved ones can do next. In some cases, the appropriate step will be to submit a new application addressing the concerns raised by the Entry Clearance Officer. In other cases, however, the Entry Clearance Officer’s decision could be unlawful, and the better course of action would be to bring a judicial review application asking a judge of the Upper Tribunal (Immigration and Asylum Chamber) to review the decision.
Whatever your UK visit visa needs, our experienced and knowledgeable team will guide you through the Immigration Rules, the procedures for making an application, challenging a refusal and what the best course of action is for your particular circumstances.
