The appeal hearing
Your appeal is a special and important day, it is your chance to present your case before an independent judge in order to allow them to make a decision by looking at the facts, listening to your story and considering the law.
At SMA, we understand the personal importance of an appeal to you and your life. We also understand the importance of ensuring every aspect of your appeal is meticulously prepared to maximise your chances of success. Your solicitors will be with you every step of the way, preparing your witness statement, advising you on the evidence needed to help your case, creating a professional and user-friendly appeal bundle, explaining the trial / hearing process and liaising with the barrister appointed to represent you in court. We firmly believe that success is achieved through teamwork. We engage with your barrister from an early stage in the appeal process and discuss your case with them. The importance of engaging with your barrister from the outset is that they spend a considerable amount of time in court, observe how judges and the Home Office work and can advise on how best to prepare your case for your day in court.
What happens if your appeal has been dismissed? Permission to appeal to the Upper Tribunal:

If your appeal has been dismissed, we can provide your with detailed advice on whether we believe that the judge has made a legal error which should be challenged by filing an application for permission to appeal to the Upper Tribunal.
SMA specialises in drafting grounds of appeal to convincingly identify the errors committed by a judge in order to obtain permission to appeal to the Upper Tribunal. If your appeal has been dismissed, please get in touch with one of our specialists lawyers who will review your case in detail.
