Afghan Asylum Appeal Allowed

SMA are delighted to announce that our client’s asylum appeal has been allowed by the First-Tier Tribunal and the Secretary of State has not sought permission to appeal to the Upper Tribunal. The Appellant, Mr Y (not his real initial) was represented in the First-Tier Tribunal by Mr Jay Gajjar, a barrister at Imperium Chambers. The appeal hearing was one of the first to be heard by video link due to the COVID-19 pandemic. The importance of this case was that the First-Tier Tribunal accepted that your client was at risk from the Taliban even though he did not fall within the risk categories identified by the Upper Tribunal in AS (Safety of Kabul) Afghanistan CG [2020] UKUT 130.
